My name is Cristiano Alves. Before founding Green, I worked for 20 years as a legal director in investment banks and technology companies.
I spent my career between London, São Paulo and the Silicon Valley (in California). I have 3 passports (American, Italian and Brazilian) and today I live and work in Austin, Texas.

Autonomy! The main difference is that the EB2 NIW allows individuals to apply for a Green Card themselves without needing a job offer or an American to sponsor them.
There are 2 types of EB-2 NIW eligibility criteria, objective and subjective.
For the objective criteria, it must be proven that you have at least:
- A Master’s, or PhD, or a Bachelor’s degree plus 5 years of experience. These are proven through diplomas and letters of recommendation proving the length of your career experience; or
- 10 years of experience in your field. Here the American immigration requires proof of at least 3 of the following 7 criteria: (i) Academic record showing that you hold a degree, certificate or similar related to your area of exceptional ability; (ii) Letters of recommendation documenting at least 10 years of experience; (iii) License to practice your profession or certification for your profession or occupation; (iv) Evidence that you have received a salary or other compensation for services that demonstrates your exceptional ability; (v) membership with professional associations; (vi) Recognition from your peers, government entities, or professional or business organizations of your achievements and significant contributions to your industry or field,; and/or (vii) Other comparable evidence of eligibility is also acceptable.
As for the subjective criteria, your case must demonstrate why it is in the US national interest to accept you as a professional without a job offer from an American employer. This national interest must be demonstrated by arguing that:
Your proposed endeavor has substantial merit and national significance.
- You are well qualified to push the proposed endeavor forward.
- All things considered, it would be beneficial for the United States to waive the requirements for a job offer.
Therefore, talking to Green about your eligibility is essential, as we will help you build the best case ,from the beginning to the end of the process.
Don’t worry about the term exceptional! This fear of not qualifying prevents many people from researching the EB-2 NIW more deeply and following through with their dreams. Exceptional ability, in this case, means that you must be able to demonstrate that you are a talented person and that your professional activity is considered to be of significant importance to the economy, science, culture, health or safety of the United States. You don’t need to be an Olympic medalist, Oscar winner, or the inventor of a cure for a rare disease!
Any professional field can qualify for the EB-2 NIW as long as the candidate demonstrates their skills in their field and their work is of national interest to the United States.
The main difference, which is significant, is the size of the investment!
For a quick, high-level illustration, the difference in investment is the following::
For the EB-5 you will spend roughly $844,000, split between the $800,000 real estate project investment, $40,000 in costs (consultants, attorneys, translations), and $4,000 in USCIS fees.
For the E-2 you will spend roughly $106,000, split between investing $100,000 in your company in the US, costs (consultants, attorneys, business plan, translations) worth $5,000, and $1,000 in USCIS fees.
For the EB-2 NIW , you will spend around $19,000 dollars, divided between $17,000 in costs (consultants, attorneys, business plan, translations), and $2,000 in USCIS fees.
These values are approximate (for Brazilians, or Brazilians who have dual European citizenship who can apply for the E-2), do not include premium processing, are for only one applicant, and are merely illustrative to demonstrate the colossal difference in the investment size for each of these pathways to the USA.

It is also worth noting that the EB-5 is an immigrant visa (a pathway to a green card) that requires substantial investment and job creation, the E-2 is a non-immigrant visa (it does not guarantee a green card) that allows investors to start or operate a business in the US, while the EB-2 NIW is an immigrant visa that requires your exceptional ability, serves the US national interest, and grants you a green card shortly after your case is approved.
